What is a Certificate of Rehabilitation?

The best place to start is by considering what this even means. A Certificate of Rehabilitation is a type of post-conviction relief in which a judge determines that a person who was previously convicted of a crime has been rehabilitated. When it is obtained, the certificate includes an automatic application for the Governor’s pardon as well.

The Many Benefits of a Certificate of Rehabilitation

If you do qualify for a Certificate of Rehabilitation, you could experience a number of benefits. For example, it may be easier for you to get a job, you may be able to obtain a professional license when you could not before, and you may no longer have to register as a sex offender.

Learn Who is Eligible for a Certificate of Rehabilitation in the State of California

Of course, not everyone is eligible for this Certificate. Generally, it is an option for a person who was convicted of a felony and sentenced to state prison, or convicted of a felony and sentenced to probation and their conviction has been expunged, or they were convicted of a misdemeanor sex offense and the conviction was expunged.

Additionally, it is only an option for people who have lived in California for at least five years, and have been rehabilitated for between two and five years after being released. The length of time required will vary based on the charge, with more serious crimes taking longer to be an option.

There Are Other Post-Conviction Relief Options

If you do not qualify for this option, do not assume you are out of options. In fact, you may qualify for a governor’s pardon, an expungement, or another type of post-conviction relief.
