Under both federal and state law, it is illegal to operate a motor vehicle while under the influence of marijuana. While truck drivers can legally use CBD oil in California when they are not working, doing so may put their livelihood in jeopardy.
The federal Department of Transportation subjects truck drivers to drug testing. This rule applies to both drivers who operate in interstate commerce as well as those who drive exclusively within California. If you drive a commercial vehicle that weighs 26,000 pounds or more, then you are required to be in a drug testing program. If a truck driver has a positive test for marijuana —even if they are not currently under the influence — then they may be penalized or not be certified as commercial truck drivers. This rule applies to both the recreational and medical use of marijuana.
