How long does a DUI conviction stay on my record?

How long does a DUI conviction stay on my record?Getting arrested for a DUI is a total nightmare scenario – and getting convicted is even worse. If you’ve been convicted of a DUI in California, you should know that it will remain on your driving record with the DMV for 10 years. That means that any DMV employee or law enforcement officer will be able to see your DUI conviction if they look you up. This record is used by the DMV to determine when you’re eligible to reinstate a suspended license and make other important decisions.

DUI and your DMV record

Before 2007, a DUI conviction stayed on your DMV record for 7 years. If you have a DUI conviction from before 2007, it’ll remain on your record for 10 years. It’s possible that the conviction will remain on your DMV for even longer in the future. The 10-year period is calculated from the date of your arrest.

Driver’s license points

Not only will your DUI conviction stay on your DMV record for 10 years, you’ll also receive points on your license. DUIs result in the highest amount of points – each DUI adds two points. DUI points stay on your license for 13 years, and cause your car insurance rates to increase dramatically. There’s no way to shorten this period.

DUI and your permanent record

Now for the really bad news – a DUI remains on your criminal record permanently. You’ll have to disclose a DUI on job and professional license applications, which may result in difficulties obtaining adequate employment.

There are three conditions for DUI expungement in California. All of these must apply:

  • You have already fulfilled all aspects of your sentence.
  • Your sentence didn’t include state prison time (jail time is okay).
  • You’re not currently facing any other criminal charges.
