How long will a DUI stay on my record?

Getting a DUI is no one’s idea of a good time. It brings serious, immediate repercussions like steep fines, license suspension or revocation, mandatory DUI class attendance, probation, and sometimes even jail time.

Long-term DUI consequences

How long will a DUI stay on my record? But the consequences don’t even end there! DUI convictions will stay part of your driving for 10 years after the date of your arrest. Law enforcement officers have access to this information so they can be aware of each driver’s history when pulling him or her over for traffic stops or a DUI sobriety checkpoints. The DMV accesses this information to determine when driver’s license reinstatement is feasible and reasonable.  It may also show up on background checks that employers or anyone else conducts. There isn’t a way to remove a DUI from your DMV record after a conviction has been suffered.

Permanent criminal record

Now for the really bad news – a DUI conviction will always be part of your public criminal record. However, there are a few ways to get this conviction expunged for your record. See if this criteria applies to you to found out if you would be eligible for expungement:

  • You’ve fulfilled all the requirements of your sentence, including probation.
  • Your sentence did not involve state prison (as opposed to jail time).
  • You’re not currently facing any other criminal charges.
