Penalties for conviction vary depending on the exact circumstances of your DUI arrest, but there are some baseline sentences that can give you an idea of what your sentence may include.

If you have any detectable amount of alcohol or drugs in your system while driving, you can be charged under California’s Zero Tolerance Law. If convicted, your license will be suspended for a year, even if you weren’t actually drunk at the time you were arrested. Even if you had a BAC (blood alcohol level) of .01% – one eighth of the adult legal limit – you can be arrested and charged with underage DUI.

If you had a BAC level of .05% or higher, you’ll also be charged with a separate infraction that carries penalties of 1 one-year license suspension (first offense), $100 fine (first offense), and if you’re 18 or over, you’ll have to attend a mandatory alcohol education program for 3 months or longer.

If you were actually impaired while driving and/or had a BAC level of .08%, you may have to pay a fine of $100 or more, attend mandatory alcohol and/or drug education program for 3 or 9 months, be on informal (“summary”) probation for 3-5 years, and you may even have to go to county jail for up to 6 months.
