Types of Forgery

You don’t have to have any particular skill at copying handwriting or documents in order to be accused of forgery. Why? Because it’s not the quality of the forged document that matters; it’s your intent. You can be charged with forgery if you take any of the following actions with the intent to commit fraud:

  • Sign someone else’s name knowing you do not have permission to do so
  • Fake a seal or someone else’s handwriting
  • Change or falsify a legal document such as a will or a deed
  • Fake or alter any document pertaining to money, finances, or property and then present it as genuine

The California Penal Code describes about 40 different types of documents that can be involved in forgery cases. Some common examples include checks, money orders, lottery tickets, real estate leases, property deeds, wills, contracts, and prescriptions.

Forgery Defense Strategies

There are two main strategies that we can employ to defend against forgery charges. First, we can seek to prove that you did not create the forged document in question through the use of handwriting experts and other witnesses. Secondly, we can try to prove that you did not intend to defraud anyone. This strategy is very effective, because without the intent to commit fraud the forgery charge basically falls apart. It is not illegal to create a fake document or sign someone else’s name if you have no intention of passing the result off as genuine in order to deprive someone of money, property, or a legal right or benefit.

If the evidence against you is very strong, we can still be of service as your forgery defense attorney. We have ample experience negotiating with DAs for fair and favorable plea deals, and we will work hard to protect you from jail time and other harsh penalties whenever possible.
