Misdemeanor Arrest and Bail Issues

The 2nd video in this series, right after the introductory video, is about misdemeanor arrest and bail issues. While many of the arrest and bail issues are similar in both felony and misdemeanor cases, there are some situations that usually only apply to misdemeanor cases.

You probably won’t be taken into custody

Attorney Chambers first shares that if you are arrested in California, you may get released without ever even having to go the police station, provided that you can supply the police officer with adequate identification, such as a driver’s license, that shows your name and address. In that case, you’ll be issued a citation that will indicate the address and time you will need to appear in court for your arraignment.

In case you are taken into custody, you should know…

However, if you do find that you are transported to a police station, you’ll probably be released as soon as you provide identification that indicates your name and address. Then you’ll be “cited out,” meaning that the arresting officer will issue you a citation or traffic ticket that indicates your court date and time for your arraignment.

Posting bail

But if you are required to post bail to be released, the bail amount will usually be set to a very low amount—less than $5,000.
