What is solicitation?

California law defines prostitution as the act of accepting money, goods, or services in exchange for performing a sexual act. All three people involved – the prostitute, the customer, and the middleman (also known as a pimp) may be prosecuted according to California law. Solicitation refers to specifically engaging in, offering to do, or agreeing to perform a sex act.

Potential penalties of a solicitation charge

While a solicitation charge often carries with it a lot of shame and embarrassment, California law isn’t actually that harsh against solicitation, except when a minor is involved. Solicitation charges are almost always misdemeanors that carry a maximum of six months in jail and a $1,000 fine.

Does a misdemeanor charge matter?

But that doesn’t mean that you don’t need an excellent lawyer to help you throughout your case. You should do everything in your power to avoid having a criminal record, even if it’s just a misdemeanor, because it can really negatively impact your life. Having a criminal record at all can make finding a place to rent and a steady job much more difficult, and the social stigma can also weigh very heavily at times. Family members may also be judgmental about it, so if you can avoid having a dark spot on your record, you should definitely do it.
