According to California law, you have the right to appeal a conviction. Different convictions, different deadlines

If you and Attorney Chambers decide to move forward with the appeals process, certain deadlines need to be kept in mind. If the conviction is a misdemeanor, you must file a Notice of Appeal within 30 days of the date of judgment or order. If it’s a felony, you have 60 days to file a Notice of Appeal.

What is an appeal?

It’s important for you to be aware that an appeal isn’t the same as a new trial. The appellate court will simply review the evidence, including testimony and exhibits, presented at the trial to see if the court made a legal error in how the testimony or exhibits were understood. The appellate does NOT decide the facts of the case like the judge or jury in the trial court does.

Conditions of appeal

Your case is only eligible for appeal if at least 1 of the following 2 conditions apply:

  • You believe that there wasn’t enough evidence in your trial to justify the verdict or judgment
  • You believe there were legal mistakes made during or before the trial that negatively impacted your case
