I was sentenced for a crime years ago that now could be adjusted because of Prop 47. What should I do?If you were convicted of a nonviolent felony, you may have the opportunity to reopen your case and possibly change your conviction because of Proposition 47, which passed California voters in November 2014.

Nonviolent crimes, such as drug possession and possession of stolen goods have been downgraded from felony charges to misdemeanors. Having a misdemeanor crime on your record isn’t nearly as much of a big deal as having a felony charge.

Felony charges impact your ability to vote, be hired for certain jobs, and even find proper housing. There’s also a social stigma that can sometimes arise if you have a felony charge on your record, especially since California criminal records are publicly available on the internet.

If there’s even a slight possibility that you might be able to remove a felony charge from your record, it’s worth looking into.

Crimes which are eligible for resentencing include:

  • Drug possession (including heroin, cocaine, methamphetamine, and other illegal drugs)
  • Shoplifting
  • Check and credit fraud
  • Forgery
  • Theft
  • Possession of stolen goods

For all of these crimes, the amount of money that has been affected because of the crime must not be more than $950. If it is, Proposition 47 has no effect on your case.
