A “wobbler” – what it is and isn’t

Now for the question immediately at hand – what is a “wobbler”? You’ve probably heard this term mentioned in legal contexts and in the news, but you may have no idea what it refers to. That’s okay! It’s actually relatively simple: a wobbler is a crime that could be charged as either a felony or misdemeanor. The law doesn’t specify a categorization for that particular crime.

Wobblers and Proposition 47

In California, as a result of Proposition 47, certain nonviolent crimes that used to be wobblers, are now firmly charged as misdemeanors in all cases. This includes drug possession, shoplifting, and fraud (when the amount of money that has been affected is less than $950).

Dealing with a wobbler now

If you’ve been charged with a crime that could be categorized as a felony or misdemeanor, you need to do everything you possibly can to make sure it’s charged as a misdemeanor. Having a felony charge on your permanent criminal record should be avoided whenever possible. Your best way of avoiding a felony conviction is by hiring Attorney Chambers to provide you with impeccable legal advice and representation throughout your case. He will fight for you every step of the way, and strive to ensure the best possible outcome is attained.
